If you are an Apple shareholder, learn to stomach the volatility. It?s not going away.

Last night Apple reported Q4 fiscal 2012 earnings. In what seems like a case of deja-vu, the stock slipped by a few percentage points in after market trading. What?s knocking Apple down this time? Well, they shipped a lower number of iPads than Wall Street expected in the quarter, and guidance for the holiday quarter is lower than expected. And the sooner we learn to ignore the short-term nature of Wall Street thinking, the better.

Just to recap, last quarter the stock dropped 5% in after market trading because of perceived weak iPhone sales and weak guidance. Then, within a few weeks, the stock had climbed from about $575 up to $700. Subsequently, it has now dropped back down to about $609. It?s a volatile stock and that?s just something you have to accept if you participate in the stock market.

The numbers

Let?s take a quick look at the key numbers: Apple delivered $36 billion in revenue and $8.66 in earnings per share (EPS). Gross margin was 40%. This is significantly better than guidance, but then again Apple is notorious for giving conservative guidance. Nothing has changed.

Apple?s largest product is the iPhone. In Q4 they sold 26.9 million units, which is up slightly from 26 million units last quarter. Customers knew the iPhone 5 was coming, and people obviously held off on iPhone purchases until it launched, considering the 5 million units sold in the first week after launch.

iPad sales were only 14 million units. This is down from 17 million last quarter, and Wall Street is a bit worried about this. Analysts expected more iPad sales, despite the fact that Apple says sales exceeded expectations. I wonder if people held off buying because of such huge anticipation for the iPad Mini, which Apple just announced this week. Still, iPad sales are up nicely on a year-over-year basis and are bound to be up dramatically in the December quarter. So I?m not worried.

Mac sales and iPod sales were solid, as usual. Macs continue to outgrow PCs, which means Apple is gaining on Microsoft in terms of OS market share. This is a trend that has been ongoing for many years, and shows now signs of slowing down. That?s great news for Apple shareholders.

Is profitability dropping?

During the Q&A session of the conference call, one analyst pointed out that if Apple?s guidance plays out, it will mean an earnings decline year-over year. Why would Apple tell Wall Street to expect the December quarter to be less profitable than last year?s comparable quarter?

CFO Peter Oppenheimer had a well-scripted and quite reasonable answer to this question. First of all, Apple?s December quarter will only be 13 weeks this year. Last year it was 14 weeks, so we should expect a 7% headwind from that alone.

But far more important is the huge refresh of products that Apple just threw at us. The iPhone 5 will be shipping for the entire quarter. The new 4th generation iPad and iPad Mini will ship for the bulk of the quarter. We?ve also got new 13? Macbook Pros and iMacs hitting us. I think Apple is correct in saying that they?ve never had a quarter with so many new products hitting all at once.

Here?s the thing about new products - they cost more to make than the prior generation of product. They have better screens, faster processors, and other component enhancements. This cost hits Apple, yet they don?t raise prices. Instead, they work their way down the cost curve over the life of the product. So the gross margin takes a hit. It?s a step change. And because Apple is launching so many products at the same time, it?s a lot of step changes in the wrong direction.

Apple is also introducing the iPad Mini, with a significantly lower price point versus other iPads. It has a lower gross margin. So profitability goes down.

As an investor, none of this bothers me so long as Apple can do two things. First, it has to prove that it can get costs down on new products just as it always has. This shouldn?t present much of a challenge. Second, they need to show me that the iPad Mini expands the overall market for iPads. If the Mini doesn?t accelerate iPad unit growth, then Wall Street can correctly say that Apple either canibalized its own profits, or was forced to take this step due to pricing pressure from competing 7? tablets.

If iPad sales improve with the new form factor, I look at is as Apple gaining more share and capitalizing on a portion of the market that was shopping elsewhere, or not buying tablets before. But if iPad sales don?t grow then Apple has simply lost profit, which is bad. For the record, I expect the former situation to unfold.

The bottom line

I?m pleased with Apple?s quarterly performance and I understand the reason for their guidance falling below Wall Street expectations. I take a longer term perspective on the business than most analysts and investors. I love the products they?ve just unveiled and it?s obvious to me that I?m more likely to increase my spending on Apple products than slow it down. If others feel the same way I do, that?s good for the stock.

In the mean time, if you are an Apple shareholder, learn to stomach the volatility. It?s not going away.

Diageo NA Posts 6% Sales Rise, Names ... - Shanken News Daily

Diageo said today that ?continued good performance? of its spirits brands in the U.S. drove a 6% organic net sales gain for its North America region in the three months through September, the group?s fiscal first quarter. That showing matched organic growth for Diageo NA in the 12 months through June, when the drinks giant reported that C?roc (especially its Peach flavor), Johnnie Walker, Ketel One, Buchanan?s and Captain Morgan all posted net sales growth of 5% or above.

Across its global business, Diageo?s organic net sales were up 5%, driven by a 16% increase in its Latin America and Caribbean unit and an 11% rise in Africa. Sales in its Asia-Pacific region advanced 2% in the latest quarter, as growth in Southeast Asia and China?especially in Scotch whisky?was partially offset by sluggish conditions in more developed areas like South Korea. Diageo announced yesterday it would double the capacity of its Glen Ord distillery in Scotland, whose Singleton brand has been rising quickly in Asia?s single malt category, selling over 100,000 cases annually. Meanwhile, Europe (-1%) continued to post mixed results for Diageo, with strong growth in the East and weaker sales in the West.

In other company news, Diageo NA has revealed its 2012 roster of Golden Bar Award winners, celebrating its leading distributor partners. Coastal Wine & Spirits of Indiana (a division of Southern Wine & Spirits), Glazer?s of Louisiana and Arizona-based Alliance Beverage (a joint venture between Glazer?s and Charmer Sunbelt) took home Distributor of the Year honors in the spirits, wine and beer categories respectively.

Military safety is blowing in the wind

ScienceDaily (Oct. 17, 2012) ? A command doctrine used by the US military and NATO designed to warn personnel of Nuclear, Chemical and Biological (NBC) hazards could be overly conservative and degrade war fighting effectiveness or, under certain conditions, risk lives because it is susceptible to changes in wind direction and speed that happen in periods shorter than its two-hourly updates.

Writing in the International Journal of Environmental Pollution, Nathan Platt and Leo Jones of the Institute for Defense Analyses, in Alexandria, Virginia explain how "Allied Tactical Publication-45(C)" relies on two-hourly updates to create an area warning map showing where NBC risks are apparent. Abrupt changes in wind speed, they say, could lead to significant false negatives or false positives for a given hazard area. The team has now developed a methodology using a transport and dispersion (T&D) model that could alleviate this problem by factoring in changes in wind.

The researchers explain that ATP-45(C) provides military personnel and commands with a warning area constructed using a set of circles and triangles, the geometric parameters of which (e.g., length and type) are generated based on wind speed and direction, magnitude and type of chemical attack and whether or not the chemical agent is considered persistent. The templates are updated at two-hourly intervals and thus do not account for variations of wind speed and direction, that occur on timescales shorter than two hours. Such a shortcoming could lead to incorrect orientation of the "triangle" template. Moreover, Platt and Jones point out that an abrupt change in the template from "circle" to "triangle" around the 10 km/h speed can distort the warning area to the detriment of at-risk military personnel.

The team's modeling approach advocates using a T&D model that can produce a time-dependent warning area in shorter than two-hour time increments, consistently handle risk, and depending on the T&D model's capabilities, could utilize additional local meteorological and terrain information. The team suggests that using a T&D model could supplement the ATP-45 hazard template in either fixed duration warning area for varying uncertainty in wind direction or for snapshots of the warning area for predetermined times and uncertainty in wind direction and/or speed.

However, "if these suggestions on the use of a T&D model to supplement ATP-45 hazard area templates are to be contemplated, then the actual values to be used require further analyses and concurrence within the Chemical and Biological Defense (CBD) community," the researchers conclude.

More than 200 local business owners participated in a Tuesday morning networking business breakfast, presented by "Union County Means Business" and hosted at the headquarters of NJ Sharing Network in New Providence.

The focus was on digital news and hyperlocal media, and featured a panel that included Lorin Kleiner, regional publisher for Patch, Julio Sabato, publisher of ElizabethInsideOut TV and Michael Shapiro, publisher of The Alternative Press.

Wendi Caplan-Carroll, of the digital marketing company, Constant Contact, briefed the group on the use of social media to grow business.

Bob Provost, marketing director of The Star-Ledger, discussed the digital transition of the state's largest daily newspaper and it's companion web site, NJ.com.

The breakfast crowd was greeted by Alexander Mirabella, chairman of the Union County Board of Chosen Freeholders, and Union County Manager Alfred Faella, who served as master of ceremonies.

The session was one of a series of special programs offered by "Union County Means Business."

Private Student Loan Gripes Echo Mortgage Complaints - NYTimes ...

Gripes received about the handling of private student loans bear an ?uncanny resemblance? to complaints about mortgage servicing during the housing crisis, and the government should consider changes to address some of the problems, says the federal ombudsman for student loans.

Rohit Chopra, the loan ombudsman for the Consumer Financial Protection Bureau and the author of a new report on private loans prepared for Congress, said yesterday that the bureau has received nearly 3,000 complaints about private student loans since March.

Unlike student loans made by the federal government, private loans lack some consumer protections, like income-based repayment plans to help borrowers manage payments, or deferments for military service. Many borrowers said they were never advised about the difference between a federal and private student loan and complained that they had not been fully informed of the terms of their loans.

The vast majority of the complaints related to servicing of the loans, like problems with fees, billing, deferments and forbearances. Many borrowers told the agency, for instance, that they had trouble getting their payments credited properly and obtaining accurate information about their loans from their servicing firms. They often ran into trouble when their loans were transferred or sold to different servicers.

The report notes that some borrowers reported problems with unauthorized payments, in cases where the borrower has a checking or savings account with the same institution that is servicing their loan. If the borrower was late with a payment, the bank might deduct the funds from the account automatically ? sometimes even charging an overdraft fee, if the payment overdrew the account.

In another instance, Mr. Chopra said, the agency heard from a borrower who was on time with payments but went into default because of a clause in the loan terms. A co-signer on the loan filed for bankruptcy, which caused the loan to go into default under the terms, even though the borrower wasn?t the one filing.

Many borrowers reported that they had tried to make ?good faith? payments toward their debt but were placed in default anyway.

A large majority of the complaints related to seven companies, with nearly half related to loans serviced by Sallie Mae. But Mr. Chopra noted that the company is a major player in making, servicing and collecting student loans, so the number of complaints ?does not seem particularly disproportionate.? Over all, he said, the distribution of complaints ?is not surprising,? given the companies? relative market share. (He also noted that the study is based mainly on borrower complaints and isn?t meant to be a statistically significant analysis of problems in the private loan industry.)

The largest share of complaints came from borrowers aged 22 to 29, suggesting that younger borrowers who have recently graduated into a tight job market are struggling, Mr. Chopra said.

Mr. Chopra?s report makes several general recommendations. Congress, he urges, should consider options that would allow student loan borrowers to modify or re-finance their loans at more attractive interest rates. It also suggests that other government officials ? specifically, the head of the consumer bureau, the Secretary of the Treasury and the Secretary of Education ? look into ways to improve servicing of such loans. The report also urges officials to consider broader application of income-based repayment plans already available for federal loans, to reduce the burden on students who also have private loans.

Retail sales jumped 1.1 percent in September | Business | Eugene ...

WASHINGTON (AP) ? Americans stepped up their spending at retail businesses in September, reflecting higher consumer confidence. The increase was driven by another strong month of auto sales and the release of the iPhone 5.

Retail sales rose 1.1 percent last month to a seasonally adjusted $412.9 billion, the Commerce Department said Monday. That followed a 1.2 percent increase in August, which was revised slightly higher. Both were the largest gains since October 2010.

Sales rose last month in most major categories. Electronics and appliances surged 4.5 percent, in part because of iPhone sales. Sales at auto dealers increased 1.3 percent. Building materials and garden supplies, furniture and clothing sales all gained, too.

The retail sales report is closely watched because it is the government's first monthly look at consumer spending, which drives nearly 70 percent of economic activity.

Economists said the September gains should help drive stronger growth in the July-September quarter.

"We expect growth to accelerate in the final quarter of the year and are supported in this view by the strong showing in retail sales," said James Marple, senior economist at TD Economics.

But some economists cautioned that the jump was driven by iPhone sales and the gain may be reversed in coming months.

"This shouldn't be considered the start of a consumer revival," cautioned Paul Dales, senior U.S. economist at Capital Economics.

Some of the increase was driven by higher prices. Gas station sales also rose 2.5 percent. And food sales increased 1.2 percent. The recent drought may have driven some food prices higher, economists noted.

Still, excluding autos and gas, sales were up a solid 0.9 percent in September.

High unemployment and weak pay increases have kept consumers from spending more freely this year. That has held back growth. The economy grew at a weak 1.3 percent rate in the April-June quarter. Most economists believe growth will stay around 2 percent for the rest of the year.

Despite weaker growth, consumers grew more confident in September. The Conference Board reported its confidence index rose last month to the highest reading since February.

The job market also looked a little better in September. The unemployment rate dropped to 7.8 percent from 8.1 percent in August. It was the first time the rate has been below 8 percent since January 2009.

And U.S. auto companies reported that sales rose 13 percent in September from a year earlier to nearly 1.2 million. Analysts think sales could hit 14.3 million this year, up from 12.8 million last year. The Federal Reserves' aggressive policies have kept interest rates low, encouraging some Americans to replace aging vehicles.

Sales at building materials and garden supply dealers rose 1.1 percent in September. Sales at furniture stores were up 0.4 percent. Sales at specialty clothing stores rose 0.6 percent. Sales at general merchandise stores, a category that includes big retailers such as Wal-Mart and Target, were up 0.3 percent in September following a 0.3 percent drop in August.

Sales at non-store retailers, the category that covers online shopping, rose 1.8 percent.

PayPal is enabling small and medium-sized merchants to offer Bill Me Later as a financing option for online transactions. Consumers can get no-interest financing for six months on purchases of $99 or more. The move should help small businesses by increasing order sizes and conversions.

PayPal is opening up its Bill Me Later service to small and medium online businesses, enabling them to offer free no-interest financing for six months for all purchases of $99 or more. Bill Me Later will give small business owners a way to increase sales conversions and boost order sizes going into the holiday season. And it expands the utility of Bill Me Later to merchants who have never been able to offer instant financing.

For merchants who participate, they will be able to offer Bill Me Later as an option at checkout and will get paid right away from PayPal. There is no upper limit for how much people can finance using Bill Me Later, and the transaction is approved or denied within about one minute. If a consumer takes longer than six months to pay off their purchase, they will pay an annual percentage rate of 19.99 percent.

PayPal is also providing business owners with 18 different types of banner ads that can be easily inserted into their home page or check-out page to highlight the Bill Me Later option.

This should be helpful for consumers who might be a little hesitant to make bigger purchases due to the tough economy. For businesses, offering Bill Me Later could push someone to add a few more items to their shopping carts if they?re short of a the $99 threshold. Forrester Research found that 43 percent of Bill Me Later sales are in addition to regular online sales and offering Bill Me Later boosted average order sizes by as much as 75 percent.

Previously, Bill Me Later was included as a funding source in the PayPal wallet, but it was almost always used by large retailers and enterprise customers. The financing offers were not consistent from one retailer to another. And merchants didn?t have a simple way of advertising the Bill Me Later option.

PayPal has been testing Bill Me Later with some small merchants and some are reporting larger average purchases through the service and a bigger percentage of sales flowing through PayPal as well.

By expanding the use of Bill Me Later, PayPal continues to show how it can become an alternative to traditional credit cards. And it demonstrates how PayPal?s purchase of Bill Me Later in 2008 is now paying off for the online payment giant. Morgan Stanley noted in March that Bill Me Later improves PayPal?s transaction margins because it?s paid off through ACH transfers or check; it generates substantial income through interest and helps eBay monetize its off-shore cash, which it uses to cover Bill Me Later transactions.

Texas Tech Law School Teams Take Top Two Spots at National Competition

Two teams from the Texas Tech University School of Law advanced to the final round of the National Entertainment Law Negotiation Competition in Los Angeles over the weekend, resulting in yet another national championship for the school?s widely recognized advocacy program.

Juliet Azarani, a third-year student from Lake Dallas; and Luke Calhoun, a second-year student from Lufkin, comprised the winning team that narrowly defeated classmates Jessica Haseltine, a third-year student from Abilene, and Sara Norman, a second-year student from Midland, in the championship round. The teams were coached by Professors Nancy Soonpaa and Wendy Adele Humphrey. The win grows the law school?s count of state, national and international championships to 29.

The competition, hosted by Southwestern University School of Law, featured 24 teams from across the nation and focused on the resolution of legal disputes in the entertainment industry. Both Tech Law teams received perfect scores in the tournament?s preliminary rounds before facing each other in the final.

?To have both our teams in the final round of a national competition and take the top two spots is simply astounding,? said Rob Sherwin, director of advocacy programs. ?It?s just disappointing both teams couldn?t be crowned national champions, because all four students deserved it.?

Sherwin said the teams? performance was a combination of talent and preparation.

?We know our students are as gifted as any across the country, but you don?t win these competitions without a ton of hard work,? he said. ?The teams and Professors Soonpaa and Humphrey worked so hard over the past month to bring this championship back to Lubbock, and we couldn?t be more proud.?

Second LulzSec member pleads guilty in Sony attack

The second person to be charged in last year's hack of Sony Pictures Entertainment, which resulted in the theft of personal information on roughly a million people, has pleaded guilty Thursday, according to reports.

Purported LulzSec member Raynaldo Rivera, 20 was charged in August with impairing a protected computer and conspiracy charges.

In admitting guilt, he joins Cody Kretsinger, who also pleaded guilty for the Sony Pictures hijack. Kretsinger is scheduled to be sentenced Oct. 25.

Rivera faced up to 15 years in prison, but with the guilty plea, he is expected to receive a shorter term when he is sentenced, scheduled for March, according to reports.

Authorities said Rivera joined Kretsinger in exploiting a common SQL injection vulnerability to gain access to internal Sony networks and websites, as part of a weeklong attack lasting from May 27, 2011 to June 2, 2011. The hack yielded the passwords, email addresses, home addresses, birth dates and other account information belonging to more than one million users, some of which publicly was posted.

At the time, LulzSec also claimed it made away with 3.5 million music coupon codes.

Rivera, whose online aliases are "neuron," "royal" and "wildicv," allegedly employed a proxy server to hide his IP address. It is unclear how authorities hunted him down, but it's certainly possible LulzSec leader-turned-FBI informant Hector Monsegur, aka "Sabu," may have helped.

Sony drew the ire of groups like LulzSec and Anonymous out of retaliation for the electronics giant pursuing legal action against George Hotz, a hacker who allegedly violated federal copyright law by jailbreaking the PlayStation 3. Both sides quietly settled the suit last year.

Felix Baumgartner's 24-mile skydive from the stratosphere on Sunday was a boon for social networks as millions of users shared in the wonder of the moment from their computers, tablets and phones.

Here's a look at how the world, through the Internet, watched the jump.

As Baumgartner ascended in the balloon, so did the number of viewers watching YouTube's live stream of the event. Its popularity grew as the moment of the jump drew closer, as people kept sharing links on Twitter and Facebook and websites embedded the stream. YouTube officials said Baumgartner's jump set a record prompting 8 million concurrent streams.

In the United States, the opportunity to watch the jump on TV was limited to the Discovery Channel, though more than 40 television networks in 50 total countries carried the lived feed, organizers said. It was streamed by more than 130 digital outlets.

FACEBOOK:

After Baumgartner landed, sponsor Red Bull posted a picture of the daredevil on his knees to Facebook. In less than 40 minutes, the picture was shared more than 29,000 times and generated nearly 216,000 likes and more than 10,000 comments. Immediately after the jump, Red Bull solicited questions for Baumgartner through Facebook and Twitter, promising to answer three at a post-jump news conference.

During the jump and the moments after Baumgartner safely landed, half the worldwide trending topics on Twitter had something to do with the jump ? pushing past tweets about Justin Bieber and seven NFL football games being played at the same time. Celebrities of all kinds weighed in, including athletes, actors and high-profile corporate executives.

"It's pretty amazing that I can watch, live on my computer, a man riding a balloon to the edge of space so he can jump out of it. (hashtag)TheFuture," tweeted Wil Wheaton, who acted in the iconic science-fiction series "Star Trek: The Next Generation."

"Felix Baumgartner is a boss," tweeted Jozy Altidore, a soccer player for the U.S. men's national team.

Two threads related to the jump made the front page of Reddit. Users quickly upvoted a request for Baumgartner to participate in an "Ask Me Anything" on the site, where users pepper someone on the site with questions about anything they want. President Barack Obama held court as the subject of a similar thread in August.

Nearly 29,000 users weighed in on a separate thread about the jump itself, voting it up and down and robustly commenting.

Rogers, CIBC may launch Suretap NFCbased payments on October 15th, require a unique SIM

Rogers and Canadian bank CIBC struck a deal for NFC-based mobile payments back in May, long enough ago that it was starting to fade out of the public consciousness. The alliance may be near refreshing our memory with a commercial launch in the cards. MobileSyrup has reportedly scored internal documents that has the two launching their e-commerce collaboration on October 15th under a slightly catchier Suretap name. Unfortunately, the text also suggests that the initial launch will require at least as much hoop-jumping from customers as for the original Google Wallet plans. Avoiding a traditional wallet will demand a BlackBerry Bold 9900 or Curve 9360 on Rogers, a CIBC MasterCard, nearby stores with PayPass terminals, a CIBC app and now a special NFC-enabled SIM card -- a set of criteria that disqualifies almost everyone, especially when there's supposedly a $50 ceiling on transactions. It remains a step forward for mobile payments in a country that has had very few options to start with, but we'd only anticipate widespread adoption once there's a much wider selection of devices and banks.

Did the administration really lie about Benghazi?

In the month since Amb. Chris Stevens and three other Americans were killed in Benghazi, I've given the White House the benefit of the doubt when it comes to explaining to the American people what really happened.

That's because raw intelligence is often conflicting, and even formal reports and cables avoid hard and fast conclusions. Intelligence scholar and former State Department analyst Jennifer Sims likes to say that the goal of the intelligence community is to add value to the policies set out by the president. ?

At the same time, the intelligence community ought to speak truth to power ??it did so, though not unanimously, before the Iraq war, when several groups of analysts found the Iraqi WMD evidence lacking.?

But here's my problem. And it is a gnawing one. According to the chairman of the House Intelligence Committee, Rep. Michael Rogers, he and U.S. Ambassador to the U.N. Susan Rice were briefed at roughly the same time and given roughly the same information.?So here is what Rice said, the Sunday after the attack:

Based on the best information we have to date, what our assessment is as of the present is in fact what began spontaneously in Benghazi as a reaction to what had transpired some hours earlier in Cairo where, of course, as you know, there was a violent protest outside of our embassy ??sparked by this hateful video. ... But soon after that spontaneous protest began outside of our consulate in Benghazi, we believe that it looks like extremist elements, individuals, joined in that ??in that effort with heavy weapons of the sort that are, unfortunately, readily now available in Libya post-revolution. And that it spun from there into something much, much more violent ? We do not have information at present that leads us to conclude that this was premeditated or preplanned.

The key assertions here are that a "spontaneous protest began outside of our consulate in Benghazi" and that "heavy weapons are?readily available" (and this organically became part of that spontaneous attack, and that "extremist elements, individuals," joined the mob-with-the-big-guns.)

Rogers concluded from the same intelligence that the attack was pre-planned and did not extend from a protest at the scene of the consulate in Benghazi.?

Let's for the moment assume that both Rice and Rogers were honest in their interpretations of the intelligence. ?

What explanation could their be for the disparate conclusions? ?

One: Maybe the administration wanted to protect sources and methods. That is, we don't exactly know HOW the intelligence community concluded that the attacks were pre-planned. If the U.S. had, say, a sensitive signals intelligence operation on the ground and was monitoring militant radio chatter and/or telephones and e-mails, that capacity is one that the U.S. would want to preserve. ?In that instance, remarks cleared for public release ??unclassified talking points based on the classified intelligence ??would be vague about the degree of certainty the U.S. had about the cause of a particular action. ?

In an intelligence report, here is what that might look like:

(TS//SI-VRK//SAMI/NF) ?An intercept from SAND CREEK captured before the attack caught a known member of al Qaeda in the Maghreb discussing "the action against the consulate" with an associate. The intercept was processed by NSA/CSS Georgia as the attack was underway and?then as a CRITIC through appropriate channels.

Now ? if you're the bad guy who planned the attacks, and the U.S. concludes within days that the attacks were "pre-planned" and announces it, you might change your communications protocols. ?

After all, Rice DID admit that "extremist" elements joined the "spontaneous" mob scene. And "heavy weapons" were readily available. ?In fact, the CIA's team in Benghazi was there precisely to pulse up counter-proliferation efforts, and the house that three of the Americans escaped to was managed by that counter-proliferation team.

But the State Department knew within days of the attacks that

  • The consulate was stormed without warning. There was no visual evidence of any protest beforehand.
  • There was no evidence AFTER the storming of the consulate that any protest formed.

In other words, in Tripoli, there were protests. In Benghazi, the U.S. consulate was attacked without warning. There were no protests.

To be extra charitable to Amb. Rice, let's assume that the intelligence about "premeditation" was NOT derived from an?"INT" source ??but that the analysts who prepared the report made inferences about premeditation based on circumstantial evidence. ?For example, ?an analyst might well write the following sentence:

  • Based on the weapons used in the attack, the speed of the entry into the consulate grounds, the number of men involved, and their knowledge of the layout, the probability is high that this element had been performing reconnaissance and preparing for the attack well before it occurred. ?

  • One that further infer that the perpetrators used the pretext of the protests in Tripoli to strike. But since attacks don't just happen, it is probably true that this team was ready to attack in advance of the inciting moment. ?
Rogers could read that and say quite correctly that it appears as if the attack was premeditated. ?

And Rice could say, I guess, that the intelligence community has no direct evidence that the attack was premeditated. ?

It is further possible that the first few reports briefed to policy makers included an error ??maybe an analyst made the same mistake that the media did, which was to conflate the protests in Tripoli with the situation in Benghazi. In the crucible, under the gun to brief top-level politician officials, these mistakes happen. And that's OK ??intelligence evolves over time and mistakes like these are subject to scrutiny and generally wash out of final reports. But when there is a time crunch, anyone can make dumb errors. ?

Congress is responsible for this as much as any other agent; the demand for briefings immediately is high, and, significantly, the demand for briefings that include releasable information requires the intelligence community to write for the public as much as they write for policy-makers. Everyone goes on TV these days, including the chair of the House intelligence committee. Now, I happen to think that it is a good thing that Rep. Rogers is willing to discuss intelligence on television. I've interviewed him a few times, and found him to be candid and honest, and he is a genuine subject-matter expert. But intelligence is still not generated for public consumption. ?

Maybe Rogers ought to have waited awhile. ?

Maybe Rice ought to have waited awhile, too. ?

But the public demands an explanation. And sometimes, that means that the intelligence process will be compromised.?

Now, it is possible, but not likely, that the CIA or DIA or NSA has concrete information NOW that the attack's origin IS less clear than they thought. And it is possible that, because of the source or method, that piece of intelligence has only been conveyed to top-level executive branch policy makers. ?

One final possibility: Perhaps Rice and Rogers were given different briefings. Perhaps, by the time Rogers had gotten his briefing, the CIA had already washed the bad intel out. But I doubt it. Rice would almost certainly have asked the State Department's intel shop for the latest assessment before she went on the air. Maybe Rice saw something like my fake Top Secret/SCI line about an intercept and Rogers didn't ? except that maybe the intercept suggested the militants were surprised by the attack.

Now let's be uncharitable to Amb. Rice. Let's suppose that she was under pressure to de-emphasize the pre-planned nature of the attacks. Why would this be??

1. If the anti-Muslim film was the major cause of the attack and al Qaeda wasn't, then maybe Americans wouldn't conclude that al Qaeda was still a major factor in Libya. After all, Obama's brags about decimating al Qaeda are central in his campaign. ?

2. Maybe the administration wanted to keep secret the fact of its large CIA presence in the region, some members of which were dedicated to finding militants who were affiliated with al Qaeda in the Maghreb. It is certainly the case that the CIA might itself ask the administration to downplay this element, at least initially.

3. Perhaps the Obama administration wanted to deflect attention away from its own meddling in the region, itself the source of much consternation, and blame the attack entirely on the film, which would be easier for them to spin to the public. ?

Motive 1 doesn't work for me. If al Qaeda or other terrorist groups were behind the attack and the intelligence community knew it, we would know it, and fairly quickly, because rarely are such broad analytical conclusions drawn about major world events and not somehow transmitted to the press. Also, the White House wouldn't get away with this lie. They would be hammered for it mercilessly as soon as it was discovered. The National Security Staff is not that stupid. Really. They're not. ?

Motive 3 doesn't work either; the response of Libya after the attack and the spontaneous pro-America?demonstrations suggest that Libyan public opinion is not virulently anti-American. ?

Motive 2 is harder to dismiss, because the CIA and the intelligence community have real equities in maintaining a presence in Benghazi and probably do a lot of things that we don't know about, and that Mike Rogers hasn't been briefed about. ?

So what the hell happened? ?

Even today, Secretary of State Hillary Clinton said that the U.S. doesn't have a complete picture of the attack. I suppose she is under some pressure to tidy up the State Department's decision to throw one of their own (Amb. Rice) under a big bus last week, and to deflect attention from Vice President Biden's assertion (true, technically) that the White House itself wasn't briefed about requests for additional security in Benghazi. But Clinton has no incentive to lie. As we've seen, the intelligence community simply will not let policy makers lie about intelligence in a way that unfairly tars the constituent members of the community. They have informal mechanisms of correcting public opinion and they use them.

I'm less concerned about this wilderness of mirrors than about the security challenges faced by diplomats, and I would hope that both Congress and the administration spend more time about THAT subject than the one I've just written about. ?

Still, the facts demand a better explanation. I'm all ears.

Netbot vs. Felix vs. Rivr: App.net apps for iPhone shootout!

While App.net (ADN) may be pretty new, it doesn't mean many users aren't already on it, including iMore and our staff. Even though the service hasn't been around for very long, there are already some choices when it comes to choosing an ADN iPhone app.

Netbot, Felix, and Rivr are all fully functional ADN apps for iPhone but is one better than the other, and more importantly, which one should you use? Follow along and we'll help you decide.

Netbot vs. Felix vs. Rivr: Interface and design

If you've ever used Tweetbot, you'll feel right at home with Netbot. The app functions almost exactly in the same way except it's feeding App.net information instead of Twitter. Swiping sideways on posts will show conversations and tapping on them will give you a menu showing different ways you can interact with the post.

There are five main sections along the bottom of Netbot that you can navigate through - stream, mentions, profile, and two customizable tabs. The last two tabs can be set up as either favorites, search, or mute filters. Holding down on either of the two tabs allows you to instantly swap them out for another option.

You compose a new post by tapping the blue compose button in the upper right hand corner. The upper left hand corner contains a button that allows you to view a drop down of all of your accounts as well as access settings. From settings you can customize sounds, font sizes, username displays, and individual account settings involving upload and read it later services.

Felix handles functions from an interface perspective differently and gives access to quick toggles you may use frequently right within your stream. While viewing your stream, you'll notice a couple options underneath each post and they are reply, repost, and favorite. Tapping any one of those will allow you to access that function. The only down side of this is that it's easy to hit the repost button on accident. While it's nice to have it there, it would be even nicer to have a confirm button pop up after tapping it. You can circumvent this for now by changing the repost function's behavior in settings to Repost with comment.

Along the bottom you have a navigation bar that consists of your main stream, mentions, compose, the global stream/stream, and dashboard. The main stream will show all the posts from users you follow, mentions will show all the posts any other user has mentioned you in, and the global stream shows all App.net posts across the entire service. The last tab, your dashboard, functions somewhat as a profile. You'll see your bio and information at the top and some functions underneath them that you can interact with. The Go to Person function allows you to quickly jump to any person's profile or stream as long as you know their handle. The Go to Hashtag function lets you jump to posts about a certain hashtag across the entire ADN service.

Underneath that you'll find statistics on yourself and basic information that you'd expect to find such as your own stream, mentions of you, follower and following count, starred individual posts, and a list of people you've muted. A little lower down you'll also see access to settings and information and a logout button. From here you can enable/disable push notifications, change what mentions you get notified for, and change a few other basic settings and thread styles. It's exactly what you'd expect to find in the settings panel of a social app.

Rivr doesn't use the same method of navigation as either Netbot or Felix. Instead of having tabs along the bottom, your stream will take up the entire screen and you can choose to pull out navigation only when you want to. To do so, tap the menu button in the upper left hand corner of Rivr. From here you can jump to any section of the app you'd like. Your usual suspects are found right here including your stream, mentions, favorites, global stream, profile, search, topics, and settings.

Your profile section doesn't show a wealth of information which is a down side I've found to Rivr but not a total buzzkill. You'll see your picture, bio, follower and following count, and a look at your own stream.

Each section in Rivr follows the same interface. You'll always see your cover photo at the top with a list of posts, mentions, or reposts below that. To compose a new post of your own, just tap the "+" sign in the upper right hand corner from any screen. This is where Rivr gets interesting. You can compose a plain text, picture, now listening to, location, or mood post. A navigation panel will pull out from the right side. Just tap on the type of post you'd like to compose and you'll be taken there.

When you see a post from someone else you'd like to interact with in Rivr you can just tap on it and your options will slide out from the right side of the screen. You can reply, quote, star it, view the entire conversation, or automatically repost it.

When it comes to interface and design, while Netbot will be an automatic choice for Tweetbot fans, Felix is a breath of fresh air. If you want a change of pace but still desire a visually pleasing app, Felix is what you'll want. Everything from the menus to the gradients are done beautifully. While Rivr is a perfectly functional and well laid out app, the interface is somewhat boring.

Netbot vs. Felix vs. Rivr: Posting and interacting with content

Netbot supports most of the functionality you'd expect to find for ADN including posting, reposting, quoting, favoriting, tagging, hashtags, image uploading and more. To compose a new post, tap the blue compose button in the upper right hand corner and you'll be taken to the compose screen. Clicking the gear button will allow you to access any drafts you have saved, clicking the button with the person on it will insert an @ sign and once you start typing someone's name, Netbot will automatically pull from your followers. You can also use the tag button in the same way to insert common or popular hashtags. The photo button does exactly what you'd expect, lets you take or insert an existing photo.

If you come across a post that appears to be a reply from something else, you can swipe across the post to the right in order to see the entire conversation. Swiping towards the left shows you full detail and any conversation below it. If you find a post that you want to do more than just view, tapping on it gives you more options. You can reply to it, repost it, star it, or chose the further action button. The further action button has more options including sending it to a read it later service, copying a link to your clipboard to the post, copying the entire post, or e-mailing the post. The last button with the gear allows you to see more details about that post including translating it or the number of reposts and stars it has received.

Felix may not have a lot of swiping and tapping gestures but most of the reason for that is the fact that most of the functions you'd use frequently are already there at your disposal. From your main stream you can easily reply, star, and repost anyone else's content instantly. Tapping into a post from your stream will give you the same options as well as more options and some information about that post. Other options you have are copying and mailing the post. Underneath these options you'll see how many people starred the post or reposted it.

The compose screen of Felix is rather plain but is still functional. The keyboard is customized to show the @ and # symbols in the bottom right hand corner. Once you hit it and then start typing a name or hashtag, Felix will automatically start trying to autofill either one for you. There's also a mailbox icon in the top bar that will house any drafts you've saved or messages that couldn't send due to an error.

Rivr offers a lot of the same functionality when it comes to content as both Netbot and Felix but in a slightly different way. Tapping the "+" sign in the upper right hand corner or swiping towards the left anywhere on the screen brings up the compose menu. From here you can choose what kind of post you'd like to make. Just like Netbot and Felix, Rivr can automatically autocomplete hashtags and usernames for you inside posts.

Composing posts is one thing where Rivr has a leg up over both Netbot and Felix. You can compose many kinds of posts that you can't natively inside either Netbot or Felix. Rivr supports not only plain posts but now playing, location, and mood posts. Photo posts are another area that Rivr may be appealing to many. Not only can you take pictures and post them but you can apply live filters to them or apply them after and right before uploading. This means there is no need to take a picture in a separate app and then upload it unless it needs further editing. For many users, the choice of filters inside Rivr will be good enough.

When it comes to viewing others content, just tap on any post you'd like to look into further inside Rivr and a menu will slide out from the side. You can choose to reply, quote, star, view the entire conversation, or repost it as is. That's about all the functionality there is to have though. If you're looking for ways to view stats on a post or a way to send them to a read it later service, you won't find them. Not yet anyways. The only thing you can currently send to a read it later service in Rivr is links. Not posts themselves.

Netbot and Felix both have far more options when it comes to read it later services and viewing information about posts. If you're into knowing how many times posts were reposted or starred, forget about Rivr for now. If you're more worried about having additional options concerning the content you share, Rivr has Netbot and Felix beat in those areas.

Tie, depending on which features are the most important to you personally.

Netbot vs. Felix vs. Rivr: Push notifications

Netbot currently doesn't offer push notifications like it's big brother, Tweetbot. We aren't sure if push will be coming to Netbot or not as of yet. Tweetbot originally released with no push notification feature and later it was added. That could be the case here.

Felix offers push notifications natively at no additional charge. In my experience, they work well and the sounds they've chosen aren't obtrusive but just enough to get your attention. There isn't too much customization as far as sounds but you'll get notifications for mentions and for most users, that'll be enough for now.

Rivr also offers push notifications but as an additional in-app purchase. The add-on is currently priced at $1.99 for one year of push notifications which is pretty fair.

Tie between Rivr and Felix.

Netbot vs. Felix vs. Rivr: Pricing

Netbot and Felix are both priced at $4.99 in the App Store which isn't too bad but may be a little high for some users. Rivr is a free download but push notifications will cost you an additional $1.99 a year, still making it cheaper than both Netbot and Felix.

If you plan on sticking around on App.net and you don't switch clients very often, Felix may be a better buy just because you'll avoid paying a push notification subscription fee year after year, which somewhat weighs out the free price tag.

Considering none of them cost a ton of money and one is subscription based, it's pretty much a wash. You're better off basing your purchase on feature set than price. Tie between all three.

Netbot vs. Felix vs. Rivr: The bottom line

Even though App.net is a newer service, you've still got quite a few options when it comes to iPhone apps. Netbot, Felix, and Rivr are three of the best, there's no doubt about that.

If you are a Tweetbot fanatic and it's your go-to Twitter client and you can't imagine using any other client, you'll love Netbot. The only downside right now is that there is no push and we're not sure how long you'll be waiting to get it. It's also worth noting that it's very easy to confuse which app you're in if you use both Tweetbot and Netbot. While the UI is familiar, I'm not sure how great of an idea it was to make them the exact same.

If push is a must for you it'll come down to Felix and Rivr.

If you're the type of person that loves to share photos, locations, and pretty much your entire life on ADN, Rivr will let you filter pictures, update your location, tell everyone what you're listening to, and more. So if what you post is more important to you, go with Rivr. But if viewing other people's content is your main concern, Felix is a better buy.

Felix wins when it comes to user interface and design. If you want an app that's easy to interact with, nice to look at, and gives you reliable notifications, look no further than Felix. For the time being, it's our favorite iPhone app for App.net.

Wild monkeys watch fights to exploit losers for grooming

ScienceDaily (Oct. 11, 2012) ? Wild macaques who are bystanders to fights within their group exploit the losers for grooming favours, new research has shown.

The findings, published in the journal Animal Behaviour, reveal previously unknown details about the important function observing others' aggressive behaviour serves in primate society, and may even help to explain why humans often hold a fascination with watching fights.

The study by Dr Bonaventura Majolo from the University of Lincoln, UK, and Dr Richard McFarland from the University of Witwatersrand, Johannesburg, South Africa, is the first of its kind to fully scrutinise 'bystander affiliation' in wild Barbary macaques (Macaca sylvanus).

Bystander affiliation describes a range of friendly social interactions, such as grooming, shared by victims and witnesses following aggressive interactions in animal societies.

Reconciliation between former adversaries after confrontations is a common and well-studied aspect of primate society but the nature of bystander affiliation is less well-understood.

It had been assumed the behaviour serves largely as consolation for the victim, alleviating anxiety felt after a defeat. However, the latest study suggests that bystanders may have more selfish motivations.

The team found that in most instances, it is bystanders who initiate contact with victims and when grooming does result, bystanders reap the benefits for longer.

They concluded that rather than offering consolation or protection, bystanders tend to exploit the vulnerable position of defeated individuals in order to elicit grooming. Grooming is not just a socially important behaviour in primate society; it also confers selective advantages, such as the removal of parasites.

Dr Majolo, from the School of Psychology at the University of Lincoln, said: "One of the reasons why we humans are so interested in watching aggressive interactions may be that these conflicts provide a wealth of important information about others in our group. There should therefore have been strong selective pressure on our ancestors to pay attention to such events.

"Our observation of grooming exploitation among wild Barbary macaques would support the theory that observing aggressive interactions between group companions can have a range of social benefits and functions."

Barbary macaques are a deeply ancestral species of macaque and the last of their kind remaining in Africa. An IUCN Red List Species, most wild populations are found in the Middle Atlas Mountains range of North Africa.

Drs Majolo and McFarland are part of an international team of academics which has established a successful field site near the city of Azrou, Morocco, where they are observing several groups of Barbary macaque in the wild comprising more than 50 individuals.

Their latest findings are compatible with their recent study which provided rare evidence of 'coercion' among primates in the wild. They found dominant Barbary macaques appeared to provoke confrontations with the sole aim of eliciting grooming from subordinates.

Acts of aggression were defined by the researchers as attempts by one animal to threaten, lunge, chase, slap, grab or bite another. Protagonists were labelled as aggressor or victim, depending on who initiated the conflict. Bystanders were also identified.

The researchers recorded 191 instances of 'post conflict' behaviour involving a victim of aggression. Around a quarter (24%) of those were examples of bystander affiliation. Of these cases, almost half (49%) were initiated by a bystander, 38% by a victim and the remaining 13% were considered to be mutual. In other words, it was more common for bystanders to approach victims immediately after aggression than the other way round. When grooming occurred, bystanders received significantly more grooming than victims.
